This Privacy Policy explains how Homefield Games, Inc. (“Homefield,” “we,” “us,” or “our”) collects, uses, and shares information about individuals who use our apps, websites, and services in the United States, with a focus on Colorado residents and the Colorado Privacy Act (“CPA”).
This Policy does not cover information collected by Participating Locations (bars, restaurants, or other venues) outside of our Program; their own privacy policies apply.
By using our services, you agree to this Privacy Policy. If you do not agree, do not use our services.
1. Information We Collect
We collect the following categories of information:
1.1 Identifiers & Contact Information
- Name, username, email address, mobile phone number
- Date of birth / age (for age verification)
- Account IDs, device IDs
1.2 Usage & Device Information
- App usage data (pages viewed, features used, time stamps)
- Device type, operating system, browser, language
- IP address and general location derived from IP
1.3 Location Information
- Precise geolocation when you enable location services and check-ins
- Approximate location from IP or Wi-Fi/Bluetooth scans
Under the Colorado Privacy Act, precise geolocation is considered sensitive data, which typically requires your consent.
1.4 Game & Loyalty Information
- Games you enter, picks/selections, scores and standings
- Points earned, status, redemptions, and visit history at Participating Locations (to the extent they are reported through our system)
1.5 Communications & Preferences
- Your marketing preferences (e.g., SMS opt-in/opt-out)
- Messages you send to us (support emails, feedback)
1.6 Inferences
- Basic preferences (e.g., favorite teams or sports) that we infer from your activity to personalize your experience.
We do not intentionally collect biometric identifiers (such as facial templates or fingerprints). If we later introduce biometric-based features (e.g., ID verification via face recognition), we will update this Policy and obtain appropriate consent consistent with Colorado's biometric data requirements.
We also do not knowingly collect personal data from individuals under age 21.
2. How We Use Information
We use your information to:

- Create and manage your account
- Operate Games and scoring
- Track Points and redemptions
- Provide location-based features (e.g., bar-specific Games, GPS check-ins)
2.2 Communicate with You
- Send service-related messages (e.g., account updates, Game alerts)
- Send marketing communications (primarily via SMS) where permitted by law and your preferences
2.3 Personalize & Improve
- Recommend Games, features, or promotions that may interest you
- Analyze usage trends and improve our services
2.4 Security & Integrity
- Detect, prevent, and respond to fraud, cheating, or misuse
- Enforce our Terms and conditions
2.5 Legal & Compliance
- Comply with legal obligations, including consumer-protection and privacy laws such as the CPA
- Respond to lawful requests from law enforcement or regulators
We may aggregate or de-identify data to analyze trends or improve our services; such data is no longer considered personal data under the CPA.
3. How We Share Information
We may share information with:
3.1 Participating Locations
- To support on-premise experiences (e.g., confirming your Points balance or eligibility for an offer at a particular bar)
- To help the location understand anonymous or aggregated trends (e.g., number of Program check-ins), where possible
We do not give bars your mobile number for their own independent SMS marketing unless you separately consent to that with the bar.
3.2 Service Providers
- SMS and communications platforms
- Cloud hosting and data storage providers
- Analytics, security, and fraud-prevention vendors
These providers are contractually required to use data only to provide services to us.
3.3 Legal & Safety
- Law enforcement, regulators, or other third parties when we believe disclosure is required or appropriate to comply with the law or protect Homefield, our users, or others.
3.4 Business Transfers
- In connection with a merger, acquisition, financing, or sale of all or part of our business.
We do not “sell” personal data for money. If we ever engage in data-sharing that could be considered a “sale” or “targeted advertising” under the CPA, we will update this Policy and provide opt-out mechanisms.
4. Cookies & Similar Technologies
We and our partners may use cookies, SDKs, and similar technologies to:
- Maintain your session and keep you logged in
- Analyze how you use the app or website
- Remember your preferences
You can control cookies through your browser settings, but some features may not work properly without them.
5. Colorado Privacy Rights (CPA)
If and to the extent the Colorado Privacy Act applies to Homefield as a “controller,” Colorado residents have the following rights with respect to their personal data:
5.1 Right to Access
To confirm whether we are processing your personal data and to request access.
5.2 Right to Correction
To request correction of inaccurate personal data.
5.3 Right to Deletion
To request deletion of personal data we maintain about you, subject to certain exceptions.
5.4 Right to Data Portability
To obtain a copy of personal data you provided in a portable and, where technically feasible, readily usable format.
5.5 Right to Opt-Out
To opt out of:
- Targeted advertising
- Sale of personal data
- Profiling in furtherance of decisions producing legal or similarly significant effects
5.6 Right to Withdraw Consent
For processing of sensitive data (such as precise location), and for certain types of profiling or targeted ads, where consent is required.
5.7 Right to Appeal
If we decline to act on your request, you can appeal our decision.
5.8 Exercising Your Rights
You can exercise your privacy rights by:

- Using in-app settings or web forms we may provide.
We may ask you for additional information to verify your identity, consistent with CPA requirements. We will respond within the time period required by law (usually 45 days, extendable in certain circumstances).
If we deny your request, we will explain why and how you can appeal.
5.9 Universal Opt-Out Mechanisms
Colorado requires controllers to recognize certain user-selected universal opt-out mechanisms (for example, browser-based signals for targeted advertising or sales). Where technically feasible and required, we will honor recognized universal opt-out signals for:
- Targeted advertising; and
- Sale of personal data (if we engage in such activities).
6. SMS & Marketing Communications
Because Homefield primarily uses SMS for marketing:
- We will send marketing texts only with your prior consent, consistent with federal law and Colorado's No-Call List rules (which treat text messaging as “telephone solicitation” in many cases).
- Each marketing text will identify Homefield as the sender and provide clear STOP/HELP instructions.
- You can opt out of marketing texts at any time by replying STOP. We may continue to send transactional messages (e.g., account security, Game confirmations) where permitted.
We may also send email or in-app messages. You can manage those preferences via settings or unsubscribe links.
7. Consent to Receive Marketing Communications
By opting in, you agree to receive marketing and promotional communications from Homefield Games, including emails, newsletters, product announcements, special offers, and other updates about our games, events, and services. You may receive communications regarding new bracket releases, updates to existing games, exclusive promotions, in-person events, merchandise, and other content we believe may be of interest to you.
You may withdraw your consent and unsubscribe from marketing communications at any time by clicking the “Unsubscribe” link included at the bottom of any marketing email, by updating your communication preferences in your account settings, or by contacting us at support@homefield.games. Please note that even if you opt out of marketing communications, we may still send you transactional or service-related messages, such as order confirmations, account notifications, security alerts, and other communications necessary to provide our services to you.
By opting in, you acknowledge that you have read and understand our Privacy Policy, which describes how we collect, use, and share your personal information, including your email address and communication preferences.
7.1 SMS/Text Message Opt-In
By opting in to text messages, you consent to receive text messages from Homefield Games at the mobile number you have provided. Message frequency may vary. Message and data rates may apply. You may opt out of text messages at any time by replying STOP to any message. For help, reply HELP or contact us at support@homefield.games. Your consent to receive text messages is not a condition of any purchase.
7.2 Third-Party Communications
By opting in to third-party communications, you consent to receive communications from select Homefield Games partners and affiliates whose products, services, or events we believe may be of interest to you. You may withdraw this consent at any time by updating your communication preferences in your account settings or by contacting us at support@homefield.games.
8. Data Security & Retention
We use reasonable technical and organizational measures to protect your personal data from unauthorized access, loss, misuse, or alteration. No system is completely secure.
We retain personal data for as long as reasonably necessary to:
- Provide the Program and the features you use;
- Satisfy legal, tax, and accounting obligations;
- Resolve disputes and enforce agreements.
We may retain de-identified or aggregated data for analytics and business purposes.
9. International Transfers
Our systems and service providers may be located in the United States or other jurisdictions. By using our services, you understand that your information may be processed outside of Colorado, subject to applicable laws.
10. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you (for example, by updating the “Last Updated” date, sending an email, or posting a notice in the app). Your continued use of the services after changes become effective means you accept the updated Policy.
