Terms of Service

These Program Terms and Conditions (“Terms”) govern your access to and use of the Homefield Games loyalty program and related free-to-play games and promotions (collectively, the “Program”) when you are physically located in any of the fifty (50) United States or the District of Columbia.

The Program is operated by Homefield Games, Inc., a Delaware corporation (“Homefield,” “we,” “us,” or “our”).

By creating an account, participating in any Game (as defined below), or redeeming rewards within the United States, you agree to be bound by these Terms and the Homefield Privacy Policy (together, the “Agreement”).

If you do not agree, do not use the Program.

1. Eligibility & Territory

1.1 Age

You must be at least 18 years of age (or 21 years of age in any jurisdiction where applicable law so requires) to use the Program.

1.2 Location

These Terms apply when you are physically present in the United States. Certain Games or features may be available only in specific states or localities based on applicable law. We may use device location data and check-ins (see Section 4) to determine your location.

1.3 No Prohibited Users

You may not use the Program if:

  • You are on a self-exclusion list maintained by Homefield, a participating bar/restaurant, or a regulator; or
  • Your participation would violate any applicable law, employer policy, or league rule.

1.4 One Account

You may maintain only one (1) account with Homefield. We may suspend or terminate duplicate or fraudulent accounts.

2. Nature of the Program

2.1 Free-to-Play; No Entry Fees

The Program is free to join and free to play. Homefield does not charge entry fees to enter Games, and no purchase is required. Any purchases you make at a participating bar or restaurant (“Participating Location”) are optional and do not affect your ability to enter or your chances of earning Credits.

2.2 Not a Fantasy Contest Operator

Certain states regulate “fantasy contest operators” that offer fantasy contests with an entry fee and require such operators to be licensed. Homefield does not operate paid fantasy contests with entry fees in any state and does not accept or process entry fees from players for Games. Our Program consists of free promotional games and loyalty activities and is separate from any licensed fantasy-contest regime under applicable state law.

2.3 No Gambling, Betting, or Sportsbook

Homefield is not a sportsbook and does not accept or pay out monetary wagers. You never stake or risk money or other property in order to participate in Games. Any Credits, badges, or status you receive are promotional only and not legal tender.

2.4 Skill-Forward Design

Our sports-related Games are designed so that outcomes depend primarily on participants' knowledge and skill, although chance and real-world events may affect results. We do not take a “house” share and do not compete in player pools.

3. Participating Locations & Rewards

3.1 Participating Locations

The Program is offered in partnership with bars, restaurants, and similar venues that agree to participate (“Participating Locations”).

3.2 Prize Promotions on Licensed Premises

State and local laws and liquor regulations may permit or restrict consumer giveaways, sweepstakes, and contests on licensed premises, subject to applicable trade-practice and tied-house rules.

Accordingly:

  • Homefield provides technology to track Credits and administer Games; and
  • Each Participating Location is solely responsible for supplying and delivering rewards (food, beverages, experiences, discounts) and for complying with all applicable federal, state, and local liquor laws and trade-practice rules in its jurisdiction.

3.3 No Alcohol Service by Homefield

Homefield does not hold an alcohol license, does not sell or serve alcohol, and is not responsible for ID checks or server decisions. All alcohol-related decisions are made by each Participating Location.

3.4 Rewards & Limitations

Credits may be redeemable at Participating Locations for:

  • Food items;
  • Non-alcoholic beverages;
  • Priority seating or waitlist priority;
  • Watch-party or event access; and
  • Other on-premise benefits listed in the app.

Alcohol-related rewards (if any) are determined and provided by the Participating Location in accordance with its license conditions and applicable state and local liquor rules and may not be available at all venues, in all states, or at all times.

4. Location Services & Check-Ins

4.1 Location Data

To determine your eligibility for Games and to ensure compliance with location-based and jurisdictional rules, we may collect precise and approximate location data from your device, in accordance with our Privacy Policy and with your consent.

4.2 Check-In Requirement

Certain Games or features may require you to:

  • Enable location services on your device; and
  • Successfully complete a GPS check-in within a specified radius of a Participating Location during a defined time window (e.g., during the first half of a game).

If you do not complete the required check-in, you may not be able to enter or continue in a Game.

4.3 No Location Spoofing

You may not use VPNs, GPS spoofing apps, emulators, or other methods to falsify your location. Doing so may result in suspension or termination of your account and forfeiture of Credits and rewards.

5. Games & On-Premise Competitions

5.1 Game Types

Game types may include (subject to availability in your state):

  • Free sports-style games based on professional or collegiate sports (e.g., picking lineups, predicting outcomes);
  • Pool-style games, such as survivor/suicide pools, pick'em pools, or bracket-style formats;
  • Non-sports games (e.g., trivia, prediction games unrelated to sports); and
  • Other on-premise engagement experiences described in the app.

(collectively, “Games”).

5.2 Official Rules

Each Game will have specific “Official Rules” describing:

  • Eligibility criteria;
  • Entry and scoring periods;
  • Scoring methods and tie-breakers;
  • Point and reward allocations; and
  • Any sport- or event-specific limitations.

The Official Rules are incorporated into these Terms by reference. If there is a conflict, the Official Rules control for that Game.

5.3 Statistics & Scoring

Unless stated otherwise, scoring will rely on third-party data (e.g., sports statistics). We may adjust scores and standings to correct obvious errors or reflect updated official data announced within a reasonable timeframe.

5.4 Fair Play & Consumer Protections

Even though Homefield is not a licensed fantasy contest operator, we follow certain consumer-protection principles, such as:

  • Limiting each player to one active account;
  • Prohibiting scripts or automated tools that provide unfair advantages; and
  • Clearly disclosing Game rules and promotional terms before you enter.

5.5 Cheating, Collusion, and Misconduct

We may disqualify you, adjust standings, void a Game, or withhold Credits or rewards where we reasonably suspect:

  • Collusion or coordinated play intended to manipulate outcomes;
  • Use of bots, scripts, or automation;
  • Multi-accounting or location fraud;
  • Harassment, abuse, or other misconduct; or
  • Violation of these Terms or applicable law.

Our determinations regarding Game outcomes and integrity are final to the extent permitted by law.

6. Credits & Rewards

6.1 Earning Credits

You may earn loyalty Credits and other status (collectively “Credits”) through:

  • Entering and participating in Games;
  • Successful check-ins at Participating Locations;
  • Completing challenges or milestones; and
  • Other activities described in the app.

6.2 No Cash Value; Non-Transferable

Credits are promotional and:

  • Have no cash value;
  • Are not legal tender;
  • Cannot be redeemed for cash or equivalents; and
  • Cannot be sold or transferred, except as explicitly permitted by Homefield.

6.3 Redemption

Redemption options will be listed in the app and may vary by Participating Location. Each location may impose its own limits (for example, caps per visit or per day) consistent with applicable law.

6.4 Expiration & Changes

We may:

  • Set expiration dates for Credits (e.g., after months of inactivity);
  • Change how Credits are earned or redeemed; and
  • Add, modify, or remove rewards.

Material changes will be communicated in the app or on our website and will apply prospectively.

7. Prohibited Conduct

You agree not to:

  • Open or maintain more than one account;
  • Share your account or log-in credentials;
  • Use bots, scripts, or automated tools;
  • Attempt to circumvent technical or geographic restrictions;
  • Interfere with the Program, reverse-engineer our software, or attempt to gain unauthorized access; or
  • Use the Program for any unlawful purpose or to violate Participating Location policies.

8. Communications & Text Messages

8.1 Consent to Receive Communications

By creating an account or participating in the Program, you expressly consent to receive communications from Homefield, including but not limited to text messages (SMS and MMS), push notifications, and in-app messages, as may be available, at the phone number you provide during registration or subsequently update in your account settings. These communications may include Game updates, score alerts, lineup reminders, results notifications, check-in prompts, Credit and reward updates, and other Program-related information.

8.2 Frequency and Content

Message frequency will vary based on your Game participation and Program activity. Homefield may send text messages related to:

  • Live Game updates, including scoring changes, leaderboard standings, and final results;
  • Upcoming Game announcements and entry reminders;
  • Credit balance updates and reward availability;
  • Participating Location events and promotions; and
  • Program changes, maintenance, or service-related notices.

8.3 Message and Data Rates

Standard message and data rates from your wireless carrier may apply to text messages sent or received in connection with the Program. Homefield is not responsible for any fees or charges assessed by your wireless carrier.

8.4 Opt-Out

You may opt out of receiving text messages at any time by replying “STOP” to any message received from Homefield or by updating your communication preferences in the app or on the website. Please note that opting out of text messages may limit certain Program features or your ability to receive timely Game updates. Opting out of text messages does not terminate your account or participation in the Program, and we may still send you transactional or service-related messages, such as order confirmations, account notifications, security alerts, and other communications necessary to provide our services to you.

8.5 Accuracy of Contact Information

You are responsible for maintaining accurate and up-to-date contact information in your account. Homefield is not liable for any communications sent to an outdated or incorrect phone number that you have provided.

9. Responsible Play

The Program is intended for entertainment only. If participation becomes problematic, you may request limits or self-exclusion by contacting support@homefield.games.

If you or someone you know has a gambling-related issue, resources such as the National Council on Problem Gambling (1-800-522-4700, ncpgambling.org) may be available.

10. Suspension & Termination

We may suspend or terminate your account or access to Games at any time, with or without notice, if we reasonably believe that you:

  • Violated these Terms or any Official Rules;
  • Engaged in fraud or misconduct; or
  • Created legal or reputational risk.

Upon termination, some or all of your Credits and rewards may be forfeited, to the extent permitted by law.

You may close your account at any time, which may also result in forfeiture of Credits and unredeemed rewards.

11. Disclaimers & Limitation of Liability

To the fullest extent permitted by law:

  • The Program is provided “as is” and “as available,” without warranties of any kind; and
  • Homefield's total liability to you for any claim arising out of or relating to the Program will not exceed the greater of (i) $100 or (ii) the reasonable value of rewards redeemed in the six (6) months preceding the claim.

Some limitations may not apply in certain cases.

12. Governing Law

These Terms are governed by the laws of the State of, without regard to conflict-of-law principles, except where (a) federal law applies, or (b) mandatory consumer-protection or other non-waivable provisions of your state of residence require application of that state's law.
